How we collect, protect, and use your personal information, and how our messaging programs comply with U.S. telecommunications rules.
1. Who We Are
Enduring Legacy Mentors (“ELM,” “we,” “us,” or “our”) operates the website at enduringlegacymentors.com and related pages (the “Site”).
This Policy explains how we collect, use, and protect personal information and how our SMS and communication programs comply with U.S. telecommunications rules, including A2P 10DLC, TCPA, and CTIA requirements.
2. Information We Collect
Information You Provide: Name, email address, phone number, company name, messages, scheduling details, form or application data, and payment information (if you purchase or book services).
Payment Processing. Payments are processed by Stripe, a third-party payment processor. Payment information is entered directly by you through Stripe's secure checkout; ELM does not receive, handle, or store your full credit card or bank account numbers.
Information Collected Automatically: IP address, device and browser information, pages viewed, referring URLs, and approximate location, collected through cookies, pixels, and similar technologies.
Information from Third Parties: Analytics providers, advertising platforms, CRMs, and referral partners, consistent with your settings on those services.
3. Estate Planning Data
In connection with our document-generation software, we collect information you provide to create your estate planning documents ("Estate Planning Data"), which may include:
Asset and property details (real estate, financial accounts, business interests, digital assets)
Beneficiary and family relationship information
Healthcare and end-of-life preferences (for powers of attorney, advance directives, and related documents)
Successor trustee and guardian designations
How We Use It. Estate Planning Data is used solely to generate your Generated Documents through our software platform, Omega, and to provide related services (trustee training, trust-funding guidance, and document customization).
Who Can Access It. Estate Planning Data may be accessed by:
ELM personnel who require access to operate the software and deliver your documents
Licensed attorneys engaged by ELM to review and approve document templates for your state, or to review and approve customizations to your specific plan
Service providers who host or process data on our behalf, under confidentiality obligations
We do not sell Estate Planning Data, and we do not use it for advertising or marketing purposes.
Retention. We retain Estate Planning Data for as long as you have an active service relationship with us, including document delivery, revisions, trustee training, or support under your plan, and for 10 years after that relationship ends, or as needed to comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your Estate Planning Data subject to the limitations described in Section 12 and subject to our ability to continue fulfilling any active support or revision commitments to you.
4. How We Use Information
We use your information to:
Operate, maintain, and improve the Site and our services
Communicate with you regarding support, appointments, updates, and marketing
Personalize content, measure performance, and manage advertising or retargeting
Prevent fraud, secure our systems, and comply with legal obligations
Evaluate interest in and qualify users for services or events
5. Sharing of Information
We do not sell personal information. We may share information with:
Service providers and processors (such as hosting providers, analytics tools, email and SMS platforms, payment processors, form tools, and CRM systems) under confidentiality obligations
Parties involved in business transfers, such as mergers, acquisitions, financing, or asset sales
Legal or regulatory authorities when required by law or to protect rights and safety
Third parties with your consent or at your direction. This excludes text messaging originator opt-in data and consent
6. Cookies & Similar Technologies
We use cookies, pixels, and SDKs for essential site functionality, analytics, and advertising. You can manage cookies through your browser settings and opt out of interest-based advertising at optout.networkadvertising.org and optout.aboutads.info.
7. Analytics & Advertising
We use analytics and advertising tools such as Google Analytics, Meta Platforms, and similar services. These third parties may set their own cookies and collect information under their privacy policies. You can learn more about Google’s data practices and opt out at tools.google.com/dlpage/gaoptout.
8. Email & SMS Communications (A2P 10DLC Compliance)
Consent to Receive Messages: By providing your mobile number through our Site, forms, chat, or text communications, you consent to receive informational and/or promotional SMS or MMS messages from ELM at the number you provided. Consent is not a condition of purchase.
Purpose of Messages: Messages may include appointment confirmations, reminders, service updates, educational content, and special offers.
Message Frequency & Rates: Message frequency varies based on your interactions with us. Standard message and data rates may apply according to your mobile carrier plan.
Opt-Out Instructions: You may opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message you receive. After opting out, we will send one final confirmation message and then stop sending messages unless you re-subscribe.
Help Instructions: For assistance, reply HELP to any message or contact us at hello@enduringlegacymentors.com.
Supported Carriers: Messages are delivered through major U.S. carriers including AT&T, Verizon, T-Mobile, and others. Carriers are not responsible for delayed or undelivered messages.
Data Handling, No Sale, and Marketing Sharing Restrictions: We collect and store mobile phone numbers, opt-in records, and messaging data solely for the purposes you have consented to, including providing informational and promotional SMS communications related to our services.
ELM does not sell, rent, or share personal information, including mobile phone numbers or SMS opt-in data, with third parties or affiliates for marketing or promotional purposes.
Mobile opt-in data, consent records, and messaging information are used exclusively to deliver the services requested by the end-user. Such information may be shared only with subcontractors or outsourced service providers strictly as necessary to provide SMS messaging services and operate our communications systems.
These service providers are contractually prohibited from using your information for their own marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be sold, rented, shared, or disclosed to any third party except as required to deliver the messaging services you have requested or as required by law.
A2P 10DLC Registration & Compliance: ELM operates registered messaging campaigns under the A2P 10DLC framework. All campaigns and numbers are registered with The Campaign Registry (TCR) to support compliance, deliverability, and anti-spam standards.
Opt-In Records & Retention: We maintain records of opt-in and opt-out consent as required by law and carrier regulations. If you re-subscribe, you authorize renewed communications until you opt out again.
Changes to Messaging Program: We may modify or suspend our messaging program at any time and will provide notice of material changes as required by law.
9. Data Retention
We retain personal information only as long as necessary to fulfill the purposes described in this Policy and to comply with legal requirements. When information is no longer needed, it is deleted or anonymized.
10. Security
We implement reasonable administrative, technical, and physical safeguards to protect your information. However, no system is completely secure, and we encourage you to use strong passwords and exercise caution online.
11. Children’s Privacy
The Site is not intended for children under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us with information, please contact us so we can delete it.
12. Your Choices & Rights
Access, Update, or Delete: You may request access to, correction of, or deletion of your personal information by contacting us.
Opt-Out Options: You may unsubscribe from emails or text messages, adjust browser cookie settings, or use industry opt-out tools.
Sensitive Personal Information. Certain information we collect—including healthcare and end-of-life preferences, and financial account or asset details provided through our document-generation software—may be considered "sensitive personal information" under applicable state privacy laws. We use this information solely to provide the services you requested (e.g., generating your estate planning documents) and do not use it for purposes unrelated to that service, such as advertising. Where applicable law provides a right to limit our use of sensitive personal information, you may exercise that right by contacting us at hello@enduringlegacymentors.com.
State Privacy Rights: Depending on your state of residence (including California, Virginia, Colorado, Connecticut, or Utah), you may have additional rights regarding access, correction, deletion, or opting out of certain data processing. Requests can be submitted to hello@enduringlegacymentors.com, and we will respond in accordance with applicable law.
13. International Users
If you access the Site from outside the United States, you consent to the transfer and processing of your information in the U.S., where data protection laws may differ from those in your jurisdiction.
14. Changes to This Policy
We may update this Policy from time to time. The effective date reflects the most recent version. Continued use of the Site after updates constitutes acceptance of the revised Policy.
