Terms of Service
The terms, conditions, and legal agreements governing your use of Enduring Legacy Mentors’ website and resources.
1) Who We Are; No Professional Advice

ELM provides educational information about wealth protection strategies, including insurance, trusts, agencies, asset protection, and tax-minimization. The Site provides general information only and does not constitute legal, tax, investment, or accounting advice. Viewing the Site or contacting us through it does not create any client, fiduciary, or professional relationship. Decisions based on Site content are at your sole risk. Consult licensed professionals for advice tailored to your situation.
Attorney-Approved Templates. The document templates and underlying logic used by our software are reviewed and approved by a licensed attorney in the applicable state before any documents are delivered to a client in that state. As we serve clients in additional states, we engage attorneys licensed in those states to review and approve our templates for that state's requirements prior to delivery. This means the templates are vetted on a state-by-state basis — it does NOT mean that each individual estate plan generated for you is separately drafted or reviewed by an attorney beyond this state-level template approval. Documents are generated by our software based on your intake information; they are not individually drafted by an attorney from scratch. If customizations or changes to your plan are needed, those changes are made and approved by our attorneys. The software provides self-help document generation only, based on the information you input. You are solely responsible for reviewing your generated documents and confirming they meet your needs and comply with the laws of your state. We strongly encourage you to have your generated documents reviewed by a licensed attorney in your state before relying on them or executing them.
2) The Document Generation Software
ELM offers software that generates estate planning documents (e.g., wills, trusts, powers of attorney, healthcare directives) based on information you provide ("Generated Documents"). By using this software, you acknowledge and agree that:
Self-help tool, not legal representation. The software is a self-help drafting tool. It does not provide legal advice, does not evaluate your individual circumstances the way an attorney would, and does not recommend a particular estate plan for you. You are responsible for deciding what type of documents and provisions are appropriate for your situation.
Accuracy depends on your input. Generated Documents are produced based solely on the information you enter. ELM does not independently verify the accuracy, completeness, or legal sufficiency of your input, and errors or omissions in your input may result in Generated Documents that do not reflect your intentions or do not meet your needs.
State-specific limitations. Estate planning law varies significantly by state. Before we deliver documents to clients in a given state, our templates for that state are reviewed and approved by a licensed attorney in that state. If you are our first client from a particular state, we will complete that state-specific attorney review before generating or delivering your documents.
Execution requirements are your responsibility. Many estate planning documents are not legally valid until properly signed, witnessed, and/or notarized in accordance with your state's requirements. The software may provide general guidance on execution, but ELM is not responsible for ensuring your Generated Documents are properly executed. Improperly executed documents may be invalid or unenforceable.
No ongoing review or updates. ELM is not responsible for monitoring changes in law, your life circumstances (marriage, divorce, birth, death, relocation, changes in assets), or notifying you when your Generated Documents may need to be updated. It is your responsibility to review and update your estate plan periodically and after major life events.
Recommend independent review. As stated in Section 1, we strongly recommend having a licensed attorney in your state review your Generated Documents before executing or relying on them.
3) Eligibility & Account
You must be at least 18 to use the Site. If you create an account, you’re responsible for your credentials and all activity under your account. Notify us immediately of unauthorized use.
4) Acceptable Use
You agree not to:
Violate laws or infringe others’ rights.
Upload or transmit malware, unauthorized advertising, or spam.
Scrape, crawl, or use automated means without our consent.
Interfere with Site functionality or security.
Misrepresent your identity or affiliation.
We may suspend or terminate access for violations.
5) Intellectual Property
The Site, including text, graphics, logos, images, videos, code, and other content, is owned by ELM or our licensors and protected by IP laws. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works. You may make personal, non-commercial use of the Site while you comply with these Terms.
6) User Content
If you submit content (e.g., messages, forms, reviews), you grant ELM a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute that content to operate and improve the Site and our services. You represent you have all rights needed and that your content is lawful and non-infringing.
Exception for Estate Planning Data. The license above does not apply to personal, financial, or health-related information you provide through our document-generation software for the purpose of creating your Generated Documents ("Estate Planning Data"), including but not limited to asset and beneficiary information, family relationships, and healthcare or end-of-life preferences. Estate Planning Data is used solely to generate your documents and is handled in accordance with our Privacy Policy, not under the content license described above.
7) Data Security
We maintain commercially reasonable administrative, technical, and organizational safeguards designed to protect information processed through the Site, including Estate Planning Data, against unauthorized access, use, alteration, disclosure, or destruction. These safeguards include account authentication controls, access restrictions based on role and need, and other measures appropriate to the sensitivity of the information involved.
Payment transactions are processed by third-party payment processors, including Stripe. ELM does not directly collect or store complete payment-card numbers. Electronic signatures, notarization services, rewards, messaging, analytics, document processing, and other functions may also be provided through third-party service providers that maintain their own security practices and terms.
We take reasonable steps to restrict access to personal information and documents to authorized users, personnel, and service providers with a legitimate need for access.
However, no method of electronic transmission, storage, or security control is completely secure. We cannot guarantee that unauthorized third parties will never defeat our safeguards or that information will never be accessed, disclosed, altered, or destroyed. You are responsible for maintaining control of your email account, devices, authentication codes, and active sessions, and for promptly notifying us of any suspected unauthorized access.
We may modify our security safeguards as technologies, risks, legal requirements, and the services we provide evolve. For details on how we collect, use, store, and retain your information, see our Privacy Policy.
8) Third-Party Links & Tools
The Site may link to third-party websites or use third-party tools. We are not responsible for their content, policies, or practices. Access at your own risk.
9) Changes to the Site
We may modify, suspend, or discontinue the Site (in whole or part) at any time without notice.
10) Disclaimers
The Site and all content are provided “as is” and “as available.” To the maximum extent permitted by law, ELM disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be error-free or uninterrupted.
11) Limitation of Liability
To the maximum extent permitted by law, ELM and its officers, directors, employees, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the Site or software.
Cap on Direct Damages. Our total liability for any claims arising from or related to the Site, the software, or your Generated Documents will not exceed the greater of (a) $4,000 or (b) the amount you paid us in the 12 months preceding the claim.
Basis of the Bargain. You acknowledge that ELM's pricing reflects this allocation of risk, and that these limitations are an essential basis of the agreement between you and ELM.
12) Indemnification
You agree to indemnify and hold harmless ELM and its affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your content, or your violation of these Terms or applicable law.
13) Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Texas (without regard to conflict of laws).
Informal Resolution. Before filing a claim, you agree to contact us at hello@enduringlegacymentors.com and attempt in good faith to resolve the dispute informally for at least 30 days.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Binding Arbitration & Class Action Waiver. Any dispute not resolved informally will be finally settled by binding arbitration in Travis County, Texas, administered by the American Arbitration Association under its Commercial Rules. YOU AND ELM EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Arbitration will be conducted on an individual basis only.
Small Claims Exception. Either party may instead bring an eligible claim in small-claims court in Travis County, Texas.
14) Termination
We may suspend or terminate your access at any time for any reason. Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, limitations, indemnities, governing law) will survive.
15) Changes to Terms
We may update these Terms from time to time. The "Effective date" above reflects the latest version. Continued use of the Site after changes means you accept the revised Terms.
Material Changes. For material changes to these Terms — including changes to Sections 1–2 (Professional Advice / Document Generation Software), 11 (Limitation of Liability), or 13 (Dispute Resolution) — we will make reasonable efforts to notify users with an active account or pending Generated Documents, such as by email or a notice on the Site, before the changes take effect. If you do not agree to a material change, your sole remedy is to stop using the Site and software.
16) SMS & Messaging Terms (A2P 10DLC Compliance)
Consent to Communications: By providing your phone number on our Site, through chat, forms, or by text message, you consent to receive informational and promotional text messages (SMS/MMS) from Enduring Legacy Mentors (“ELM”) at the number you provided. Consent is not a condition of purchase.
Message Frequency: Message frequency varies by interaction type (e.g., appointment confirmations, reminders, service updates, educational messages, or promotional offers).
Message & Data Rates: Message and data rates may apply according to your mobile plan. Check with your carrier for details.
Opt-Out Instructions: You may opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any ELM message. You may also contact us at hello@enduringlegacymentors.com to opt out. After you text STOP, we will send a final confirmation message and then no longer send texts to that number unless you re-subscribe.
Help Instructions: For help, reply HELP or contact hello@enduringlegacymentors.com.
Supported Carriers: Message delivery is supported by most major U.S. carriers, including AT&T, Verizon, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.
Data Privacy: We value your privacy and handle SMS data in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
A2P 10DLC Registration: ELM operates registered messaging campaigns under the U.S. A2P 10DLC framework. All numbers and campaigns are verified and registered with The Campaign Registry (TCR) to ensure carrier compliance, message deliverability, and anti-spam standards.
Changes to Messaging Program: We may modify or suspend our messaging program at any time. We will notify you of material changes to these SMS Terms as required by law.
